Terms of Service

The terms and conditions for using Eternal Dawn and its services.

These Terms of Service ("Terms") govern your access to and use of Eternal Dawn, including the game, website, forums, and all related services (collectively, "Services") provided by ENS YAZILIM VE BİLİŞİM TEKNOLOJİLERİ TİCARET LİMİTED ŞİRKETİ ("we", "us", "our"). By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

1. Eligibility

The minimum age requirement for Eternal Dawn has not yet been finalized and will be specified before the game's public launch. You must meet the applicable age requirement to create an account and use our Services. You are responsible for ensuring that your use of our Services complies with the laws applicable to you. If you are creating an account on behalf of a minor (where permitted), you accept these Terms on their behalf and are responsible for their use of the Services.

2. Your Account

You may create only one account per person. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must not share, sell, trade, or transfer your account to any other person. You must not use another person's account. If you believe your account has been compromised, you must notify us immediately through our support system. We are not responsible for any loss or damage arising from unauthorized use of your account.

3. Game Development Phases

Eternal Dawn is being developed in phases. The terms that apply to you may vary depending on the current phase of development. By participating in any phase, you acknowledge and accept the conditions specific to that phase as described below.

Testing Phases (Alpha, Beta, Open Tests)

During testing phases, the game is provided entirely free of charge for the purpose of testing and feedback. The game is incomplete and under active development. You should expect bugs, instability, missing features, and significant changes between updates. We reserve the right to wipe, reset, or delete any and all game data — including characters, items, progress, and housing — at any time, for any reason, without prior notice. Features, game mechanics, and content may be added, changed, or removed at our sole discretion. No compensation will be provided for any data loss, wipes, or changes during testing phases. Your participation helps us improve the game, and we appreciate your feedback.

Early Access

During early access, the game is playable but still in active development. While we aim to minimize disruption, the game may still undergo significant changes, including balance adjustments, feature additions or removals, and occasional data modifications. Early access introduces the free-to-play model with an optional subscription. The conditions described in the Subscription and Payments section apply from this phase onward.

Full Release

Upon full release, the game is considered a live service. We will continue to update and improve the game, but changes will follow a more structured process. The free-to-play model with optional subscription continues. Standard service terms apply as described in these Terms.

4. Subscription and Payments

Eternal Dawn is free to play. All players have access to the core game, but free accounts are subject to certain gameplay limitations — such as reduced progression rates, limited character slots, and other restrictions — designed to encourage subscription while keeping the game accessible to everyone. The specific limitations may change as the game evolves and will be detailed on our website. We offer an optional subscription that removes these limitations and provides the full gameplay experience. There is no in-game store, and we do not sell cosmetic items, loot boxes, or any form of microtransaction. The subscription is the only paid offering. Subscription fees, billing cycles, and included benefits will be detailed on our website when the subscription becomes available. You may cancel your subscription at any time. Upon cancellation, you will retain access to subscription benefits until the end of your current billing period. After your billing period ends, your account will revert to the free tier with its associated limitations. Refunds will be handled in accordance with applicable consumer protection laws.

5. User Conduct

You agree to use our Services respectfully and in a manner consistent with our Community Guidelines. The following activities are strictly prohibited:

  • Cheating or hacking — using unauthorized software, modified game clients, cheat engines, or any tools that provide an unfair advantage over other players.
  • Botting and automation — using bots, macros, scripts, or any form of automated gameplay that plays the game without direct human input.
  • Harassment and toxic behavior — engaging in harassment, bullying, hate speech, threats, discrimination, or any behavior intended to harm, intimidate, or create a hostile environment for other players.
  • Real-money trading (RMT) — buying, selling, or trading in-game items, currency, characters, or services for real-world money or other real-world value outside of our official systems.
  • Account sharing or selling — sharing your account credentials with others, allowing others to access your account, or selling, buying, or trading accounts.
  • Impersonation — pretending to be a staff member, game master, moderator, or another player with the intent to deceive.
  • Offensive names — using character names, housing names, or forum display names that are vulgar, offensive, discriminatory, or otherwise inappropriate.
  • Exploiting bugs — intentionally abusing bugs, glitches, or unintended game mechanics for personal gain instead of reporting them. Responsible disclosure of bugs through our support system is encouraged and appreciated.

6. Enforcement

We reserve the right to take action against any account or user that violates these Terms or our Community Guidelines. Enforcement actions are taken at our sole discretion and may include, but are not limited to:

  • Warnings — a formal notice that a violation has occurred and that continued violations will result in further action.
  • Temporary suspension — your account may be temporarily suspended for a defined period, during which you will be unable to access the game and related services.
  • Permanent ban — in cases of severe or repeated violations, your account may be permanently terminated. All associated game data, characters, and progress will be forfeited.
  • Content removal — we may remove, modify, or rename any user-generated content, characters, items, or housing that violates these Terms, without prior notice.

If you believe an enforcement action was taken in error, you may submit an appeal through our support system. We will review appeals in good faith, but the final decision rests with us.

7. User-Generated Content

You retain ownership of the content you create, such as forum posts, character names, housing designs, and uploaded images ("User Content"). However, by submitting User Content through our Services, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, display, reproduce, modify, adapt, publish, distribute, and remove your User Content in connection with operating and providing our Services. We may moderate, edit, or remove any User Content at our sole discretion, for any reason, without prior notice or obligation. We are under no obligation to store, maintain, or provide copies of your User Content. You are solely responsible for your User Content and must ensure it does not violate these Terms, our Community Guidelines, or any applicable laws.

8. Intellectual Property

All content, materials, and assets within Eternal Dawn — including but not limited to the game software, artwork, music, sound effects, text, logos, user interface design, game mechanics, and server code — are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial entertainment purposes, subject to these Terms. You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works based on any part of our Services without our prior written consent.

9. Service Availability

We strive to keep our Services available and running smoothly, but we do not guarantee uninterrupted or error-free access. Our Services may be temporarily unavailable due to scheduled maintenance, updates, technical issues, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We are not liable for any loss or inconvenience caused by service interruptions or discontinuation.

10. Limitation of Liability

To the maximum extent permitted by applicable law, our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, including but not limited to loss of data, loss of game progress, loss of virtual items, or interruption of service. During testing and early access phases, the risk of data loss, wipes, and significant changes is inherent to the development process, and you accept this risk by participating. Nothing in these Terms limits or excludes our liability for matters where liability cannot be limited or excluded under applicable law.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, practices, or applicable laws. When we make material changes, we will notify you through our website or in-game notice. Your continued use of our Services after changes take effect constitutes your acceptance of the updated Terms. If you do not agree with the changes, you should stop using our Services and may request deletion of your account.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from or relating to these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Turkey, without prejudice to any mandatory consumer protection provisions that may apply in your jurisdiction.
